Served a Protection Order in Colombia? What the Notice Means

A Comisaría de Familia Just Served You a Notice. Here Is What It Actually Says

It usually arrives without warning. A document slipped under the door, handed over by a police officer or sent by email, full of legal Spanish, case numbers and words like medida de protección and audiencia. For a foreigner whose relationship with a Colombian partner has just broken down, it can be one of the most alarming pieces of paper they ever receive.

Take a breath. A protection order is serious, and it has to be taken seriously, but it is not a criminal conviction and it does not decide anything permanently on its own. What it does do is start a process with short deadlines, and what you do in the next few days matters a great deal.

Here is how to read the notice, one piece at a time.

Who sent it: the Comisaría de Familia

Family commissioner offices, the comisarías de familia, are local administrative bodies that handle violence within families and couples. Their role was strengthened by Law 2126 of 2021, which covers spouses and partners even after they separate, and not only physical violence but also psychological, economic and property-related harm, threats and intimidation.

A comisario is not a criminal judge. They cannot send you to prison for the original incident. But they can impose binding orders, and breaking those orders has real consequences.

“Medida de protección provisional”

This is the part people panic about. It means the commissioner has already ordered temporary measures, often within hours of the complaint, based on an initial account. The law allows this on fairly limited evidence because its purpose is to protect someone quickly while the facts are examined.

Typical provisional measures include an order to stop the alleged conduct, to stay away from the other person, not to contact them, or in some cases to leave a shared home. You cannot appeal a provisional measure, but you must comply with it immediately, even if you believe the complaint is false. Contacting your partner to “sort it out” is the single most common way people turn a defensible case into a sanction.

“Citación a audiencia”

The notice will give a date, time and place for a hearing, sometimes in person and sometimes online. Under Law 575 of 2000, which sets out much of the procedure, the hearing is normally held within days of the complaint, not months.

Read this line twice. If you do not attend and do not have a valid excuse, the law treats you as accepting the facts alleged against you. Many foreigners lose at this stage, not because the accusations were true, but because they were traveling, did not understand the notice, or assumed it would go away. If you genuinely cannot attend, one justified excuse can lead to the hearing being rescheduled, but you have to ask for it.

“Descargos” and “pruebas”

At the hearing you have the right to respond to the accusations, known as presenting your descargos, and to submit and request evidence. That can include messages, emails, photos, witness statements, and anything else showing what actually happened. The commissioner will also try to find a solution to the conflict, and it is not unusual for both sides to agree on terms that end the dispute.

Bring an interpreter if your Spanish is not strong. This is not the place to guess at what is being said. It is also where foreigners who receive these notices benefit most from having someone represent them, because the hearing is where the final measures are decided.

“Medida de protección definitiva”

After the hearing, the commissioner decides whether to make measures permanent, change them or reject the request. Final measures can include the same orders as provisional ones, plus things like therapy, paying for the other person’s medical or psychological treatment, or rules about contact with children.

A final decision can be appealed to a family judge. Measures can also be lifted later if the circumstances that justified them have changed, so a protection order is not necessarily permanent.

“Incumplimiento”

If you see this word, someone is claiming you broke an order. A first breach can lead to a substantial fine, which can be converted into arrest if unpaid. A second breach within two years can mean arrest of up to several weeks. This is why strict compliance from day one is so important, however unfair the original order feels.

The parts that affect foreigners most

A protection process often runs alongside other things. The same facts can lead to a separate criminal complaint for domestic violence with the Attorney General’s Office, and a protection order can become central evidence in later custody, visitation or divorce proceedings. A short, poorly handled hearing at a comisaría can echo through every family case that follows.

If children are involved, expect the commissioner to look closely at contact arrangements. If you share a home, think carefully about where you will stay before anything is ordered. And if you have plans to travel, raise them early rather than leaving the country mid-process.

For a broader overview of how comisarías work and what they can order, this summary of the law on comisarías is a useful starting point. But the most important thing is simple. Read the date on the notice, comply with every provisional order, and show up.

This article is general information, not legal advice. If you have received a notice, get advice on your specific case before the hearing date. If you are at risk of harm, contact local authorities immediately.
